Arbitration is generally conducted under the rules of arbitral institutions and in the UAE. This typically means the rules of ADCCAC (in Abu Dhabi), DIAC (in Dubai) and the ICC and LCIA.
Where appropriate, and where the cost is proportionate to the dispute, we may advise on bringing particular technical experts and advocates (barristers) to assist the team.
Our arbitration lawyers in UAE represented a main contractor in successfully bringing an arbitration claim against a developer which had underpaid it by AED 100m for the construction of a super tall tower in Dubai Marina. The hearing took place during the covid pandemic, so a hybrid hearing was held over a week with the arbitrators, counsel and witnesses appearing both in person and remotely.
We successfully defended a Master Developer against a claim for AED 350m in DIAC arbitration proceedings. The claim being completely withdrawn after our Answer was submitted.
Our arbitration lawyers represented a project management company in an arbitration brought under LCIA Rules. The hearing was a held remotely on paper and the client received an Award in its favour.
We advised on a claim by a main sub-contractor against the main contractor for termination, underpayment, wrongful call on the performance bond and liability to its subcontractors.
